Terms of Service

1. Acceptance of Terms

By accessing or using iTrading Buddy, you confirm that you are at least 17 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

iTrading Buddy is a stock market tracking application for iOS that provides:

• Real-time and delayed stock price quotes
• Custom watchlists and portfolio tracking
• Price alerts and notifications
• Lock screen and home screen widgets
• Financial news headlines and sentiment analysis
• Technical indicators and charting tools
• Earnings calendar and company information
• AI-powered stock analysis and insights (powered by third-party AI models)

The App is an informational tool only. It does not provide investment advice, brokerage services, or trade execution capabilities. Nothing in the App should be construed as a recommendation to buy, sell, or hold any security.

3. Subscription Terms and Billing

3.1 Free Tier

The App includes a free tier with limited functionality. The free tier may be used indefinitely at no cost.

3.2 Pro Subscription

iTrading Buddy Pro is an optional auto-renewable subscription that unlocks all features. You may choose between two billing options (or their local-currency equivalents as determined by Apple):

• Monthly: $9.99 USD per month. New subscribers are eligible for a one-time 7-day free trial (offered once per Apple ID).
• Annual: $99.99 USD per year. The annual plan does not include a free trial.

3.3 Payment and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
• You can manage and cancel your subscription at any time through your iPhone Settings under Subscriptions

3.4 Price Changes

We reserve the right to change subscription pricing. Any price change will take effect at the start of the next billing cycle following notice of the change. Your continued use after the price change becomes effective constitutes your agreement to pay the updated amount.

3.5 Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple through their standard refund process. We do not have the ability to issue refunds directly.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App to engage in market manipulation or any illegal trading activity
• Not redistribute, resell, or sublicense the App or any data obtained through it
• Maintain the security of any API keys you provide to the App
• Acknowledge that financial data may be delayed, inaccurate, or incomplete, and that all investment decisions are your sole responsibility

5. Intellectual Property

All content, design, code, graphics, logos, and trademarks in the App are the intellectual property of the developer or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Modify, adapt, or create derivative works based on the App
• Use the App's name, logo, or branding for any purpose without prior written consent
• Extract or scrape data from the App for redistribution

6. Third-Party Services and Data

The App relies on third-party financial data providers (including Twelve Data, FRED / the St. Louis Federal Reserve, SEC EDGAR, Brave Search, and Google News) to supply market data, fundamentals, filings, news, and the economic calendar. We do not guarantee the accuracy, completeness, or timeliness of any data provided by these services. Third-party services may experience downtime, rate limiting, or data errors that are beyond our control.

7. AI-Generated Analysis & Insights

The App includes an AI-powered analysis feature that generates stock insights using artificial intelligence (currently provided by Anthropic's Claude API). All AI-generated content is provided "AS IS" strictly for informational and educational purposes. By using the AI features, you acknowledge and agree that:

• AI-generated analysis does not constitute financial advice, investment recommendations, or any form of professional guidance. It must not be used as the sole or primary basis for any investment, trading, or financial decision.
• AI outputs may be inaccurate, incomplete, outdated, or misleading. The AI model may produce errors, hallucinations, or statements that appear authoritative but are factually incorrect. We make no warranty regarding the accuracy, reliability, or completeness of any AI-generated content.
• AI analysis is generated based on limited data points (price, recent news headlines, and basic company information) and does not reflect a comprehensive evaluation of any security, market condition, or investment opportunity.
• You use AI-generated features entirely at your own risk. The developer, its affiliates, and the AI service provider shall not be liable for any losses, damages, or claims arising from your reliance on AI-generated content.
• AI-generated content may be cached on your device for a limited period to reduce unnecessary API usage. Cached results may not reflect the most current market conditions.
• The AI feature is subject to daily usage limits and may be modified, restricted, or discontinued at any time without prior notice.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, timely, secure, or error-free
• Market data displayed will be accurate, complete, or current
• The App will meet your specific requirements
• Any errors in the App will be corrected

You acknowledge that stock market data can be delayed, and that real-time data depends on third-party API availability. Trading decisions based on information from the App are made at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or anticipated savings
• Loss of data
• Financial losses resulting from trading decisions influenced by the App
• Business interruption

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless the developer from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may terminate your use of the App at any time by deleting it from your device and canceling any active subscription.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the Effective Date at the top of this page and may provide additional notice through the App. Your continued use of the App following any modifications constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the courts located in the State of Florida.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the developer regarding the use of the App and supersede all prior agreements and understandings.
